Kirby Aisner & Curley Successfully Confirms Individual Chapter 11 Plan

On April 13, 2020, the Southern District Bankruptcy Court entered an Order confirming the Chapter 11 Plan of individual debtor, Dimitrios G. Galanopoulos. The Debtor was the owner of NDG Coffee Shop, Inc. which operated a pizzeria in the Upper West Side of New York City. Following a series of attacks and accusations by former employees alleging violations of the Fair Labor Standards Act (“FLSA”), the Pizzeria was forced to closed and the owner filed a personal bankruptcy .

The filing of the Chapter 11 enabled the debtor to settle the FLSA claims, with a payout over 6 years.

Kirby Aisner & Curley Successfully Guides Brooklyn Affordable Housing Developer Through Chapter 11

January 31, 2020

On January 31, 2020, the Eastern District Bankruptcy Court entered an Order confirming the Chapter 11 Plan of Brooklyn Buildings LLC. The debtor is the owner of a portfolio of distressed multi-family homes in Brooklyn which is part of the “Neighborhood Homes Program,” administered by the New York City Department of Housing Preservation and Development.

The filing of the Chapter 11 enabled the debtor to stay  the pending foreclosure of the multi-million dollar portfolio. Under the guidance anf expertise of Kirby Aisner & Curley, LLP, not only was the debtor able to resolve open issues with HPD but it was able to close on $3 million in exit financing which refinanced certain high interest mortgage debt and funded rehabilitation of the properties.

Kirby Aisner & Curley is proud to announce that effective January 1, 2020, Jessica Hill has joined the Firm as an associate attorney. 

Jessica’s practice focuses on representing individuals in consumer bankruptcy filings. She has significant experience advising clients in Chapter 7, Chapter 13, and Loss Mitigation.

The breadth and depth of Jessica’s experience and her kind and patient demeanor will be an important asset to the Firm, particularly as it continues to grow and expand its consumer bankruptcy practice.

Jessica joins the firm from a boutique bankruptcy firm in the Hudson Valley, where she worked in various capacities over the past 10 years. Jessica received both her J.D. and B.A. from the Quinnipiac University.

On October 21, 2019, the Westchester Business Journal reported on a lawsuit filed by Dawn Kirby. Dawn represents an investor who obtained a $500,000 judgment against his former financial advisor, who in turn filed for chapter 11 protection. Dawn and her client are asking the bankruptcy court to find the judgment is not dischargeable in bankruptcy.
