Dawn Kirby and Jessica Hill Attend NACBA Annual Convention

On May 19 – 21, 2022, Dawn Kirby and Jessica Hill attended the National Association of Consumer Bankruptcy Attorneys’ 30th annual convention in Tucson, Arizona.  NACBA is a national organization dedicated to enhancing rights of consumer bankruptcy debtors.

Erica Aisner confirms Subchapter V Plan for New York Classic Motors, LLC

On May 2, 2022, Erica Aisner successfully confirmed the Subchapter V Chapter 11 Plan of Reorganization for New York Classic Motors, LLC which operates the Classic Car Club in New York City. This unique membership based private luxury automobile club is located on Pier 76 on New York City’s west side. Pier 76 was leased by the Club from the Hudson River Park Trust (HRPT) which sought to evict the Club for failure to pay rent following the Covid-19 pandemic. As a result of the bankruptcy filing, the Club was able to stave off an eviction, negotiate an extended occupancy period during which it would be able to identify and relocate to a new home,  and ultimately proposed a Plan that restructured its obligations as it got back on its feet post-pandemic. Under the Plan, the Club was able to discharge significant arrears that were owed to HRPT and its vendors and suppliers received a significant recovery on their claims.

Dawn Kirby Confirms Plan Removing Tax Liens from Debtor’s Home

On April 15, 2022, Dawn Kirby confirmed a chapter 11 plan for a medical doctor based in Manhattan.  With the proceeds of the settlement of a lawsuit against the manager of the doctor’s former practice, the doctor was able to remove a tax lien from her residence and pay a dividend to her mostly business-related creditors. The doctor’s mortgage was also modified to an affordable payment.

Julie Curley Confirms Subchapter V Plan for Individual Debtor

On April 1, 2022, Julie Curley confirmed a Subchapter V Plan for an investor who was embroiled in litigation with his business partners for nearly 10 years. The confirmed Plan allowed the Debtor to finally resolve the dispute, obtain a fresh start, and focus his time and energies on new ventures.
